PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
Acknowledgment and Assumption of Risk
I understand that participation in fitness classes, movement activities, and related programs offered by Encircle Movement ("Encircle Movement") involves inherent risks, including but not limited to muscle strains, sprains, falls, physical injury, illness, property damage, and other unforeseen risks.
I further understand that Encircle Movement fitness classes involve the presence of infants, toddlers, and young children who may be crawling, walking, playing, or moving throughout the class environment. I acknowledge that participation may involve risks associated with children, toys, play equipment, and interactions with other participants.
I knowingly and voluntarily assume all risks, known and unknown, associated with my participation and my child's participation in Encircle Movement classes, events, workshops, and programs.
Health and Medical Acknowledgment
I certify that I am physically capable of participating in exercise activities and have no medical condition that would prevent safe participation.
If I am participating postpartum, I affirm that I have received appropriate medical clearance to resume physical activity following childbirth.
I understand that I am responsible for monitoring my own physical condition and my child's well-being during all activities and will stop participation if I or my child experience pain, discomfort, illness, or any other concerning symptoms.
Parental Responsibility
I understand that Encircle Movement is not a childcare provider.
I agree to remain present with my child at all times and accept full responsibility for my child's supervision, behavior, safety, and participation during classes, events, and activities.
I agree to take reasonable steps to ensure my child does not endanger themselves, other children, participants, instructors, staff members, or property.
Release and Waiver of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Encircle Movement, its owners, instructors, contractors, employees, volunteers, affiliates, host venues, and representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or relating to my participation or my child's participation in any Encircle Movement class, event, workshop, or activity.
This release includes, but is not limited to, claims arising from personal injury, illness, property damage, disability, death, or any other loss, whether caused by negligence or otherwise.
Emergency Medical Authorization
In the event of an emergency involving me or my child, I authorize Encircle Movement and its representatives to seek emergency medical assistance if necessary.
I understand that Encircle Movement assumes no responsibility for medical expenses incurred and that all costs associated with emergency medical treatment remain my responsibility.
Photography and Video Release
I understand that photographs and video recordings may be taken during Encircle Movement classes, events, workshops, and programs for marketing, promotional, educational, and business purposes.
I grant Encircle Movement permission to use, reproduce, publish, and distribute photographs, video recordings, and other media that may include my likeness and/or my child's likeness in print, digital, social media, website, advertising, and promotional materials without compensation. Encircle Movement is committed to creating a respectful and family-friendly environment. As part of this commitment, Encircle Movement does not intentionally feature children as the primary subject of marketing content and generally blurs or obscures identifying facial features when children appear in photographs or video.
I understand that I waive any right to inspect, approve, or receive compensation for the use of such photographs, video recordings, or media.
Venue Acknowledgment
I understand that Encircle Movement classes and events may take place at various indoor and outdoor locations, including fitness studios, farms, parks, community spaces, and partner venues.
This waiver applies to all Encircle Movement programs and activities regardless of location.
Agreement to Terms
I have carefully read and fully understand this Waiver, Release of Liability, and Assumption of Risk Agreement.
I understand that by signing this document I am waiving certain legal rights, including the right to bring legal claims against Encircle Movement and related parties.
I sign this agreement voluntarily and acknowledge that it is intended to be as broad and inclusive as permitted by applicable law.
